Høring av barn i meklingsprosessen – en utforsking av mekleres dilemmaer

Abstract

I Norge er det er et økende fokus på barns rett til å bli hørt ved obligatorisk mekling mellom foreldrene ved samlivsbrudd eller før foreldretvistsaker i domstolen. For å inkludere barn i meklingsarbeid er det utviklet flere modeller. En av disse er meklingsmodellen Barn i mekling (BIM). I BIM-modellen har barnet en egen samtale med mekler før meklingen gjennomføres med foreldrene. Artikkelen bygger på kvalitative intervju med 12 meklere med erfaring fra bruk av BIM-modellen og retter oppmerksomheten mot dilemmaer meklere erfarer, og hvordan de forholder seg til disse dilemmaene. Dette er et lite utforsket tema. Studien kan således beskrives som eksplorerende og beskrivende. Resultatene som presenteres gjennom empiriske eksempler, viser at meklers dilemmaer knytter seg både til meklers forståelse av egen rolle, forholdet mellom barns rett til beskyttelse og deltakelse, tolkning av formålet med barnesamtalen i BIM-modellen og barns råderett over egne utsagn.

In Norway there is an increased focus on children’s right to participate in family mediations in cases concerning parents’ separation or preceding a dispute in court. Different models are developed to include children in family mediations. One of these models is Children in Mediation (Barn i mekling, BIM). In this model the child has a separate conversation with the mediator preceding the mediation with the parents. The article is based on qualitative interviews with 12 mediators. The article focuses on dilemmas experienced by the mediators and how they cope with the challenges they meet. The study is described as explorative and descriptive. Some of the mediators’ dilemmas concern the mediator’s role and the relation between the child’s legal right to protection and at the same time participation. How to interpret these intentions while involving the child, and the child’s beneficial right of its own statements, is discussed.
