La tutela costituzionale dell'ambiente, della biodiversita' e degli ecosistemi, anche nell'interesse delle future generazioni

Abstract

The contribution analyses the reform of Art. 9 of the Italian Constitution, whereas it establishes the duty of the State “to protect the environment, biodiversity and ecosystems, also for future generations, referring to the legislator the authority to enact animal protection legislation.” The comment touches upon a few key aspects of the reform: its framing within the critical systems thinking approach, its opening towards a wider subjectivity in the environmental protection action, the importance of both legislator and the rule of law advancing the instances of the climate and environmental justice movement.

Il contributo analizza la riforma dell’Art. 9 della Cost. it., laddove “la tutela dell'ambiente, della biodiversità e degli ecosistemi, anche nell’interesse delle future generazioni” viene inserita tra i principi fondamentali dalla Carta costituzionale, rinviando al legislatore il compito di stabilire i modi e le forme di tutela degli animali. Il commento analizza alcuni punti chiave della riforma: il suo inquadramento all’interno del pensiero sistemico, l’ampliamento della soggettività giuridica nell’ambito del diritto ambientale, supportando il ruolo fondamentale esercitato dal legislatore nel riconoscimento di principi fondamentali all’interno del movimento di giustizia ambientale e climatica.
