Privatrettslige forhold i byggesaksbehandlingen

Abstract

Siktemålet med avhandlingen er å kartlegge de rettslige rammer for bygningsmyndighetenes adgang til å avvise tiltakshavers byggesøknad, som følge av at privatrettslige rettigheter ikke er sikret, jf. pbl. § 21-6 første ledd andre punktum.

The aim of the thesis is to clarify the legal framework governing the building authorities’ right to reject a developer’s building application, on the grounds that the private law rights required for the application have not been secured, cf. Section 21-6, first paragraph, second sentence of the Planning and Building Act.
