      For å forsøke og svare på om barns rettssikkerhet er ivaretatt ved idømmelse og fastsetting av ungdomsstraff er det redegjort for bestemmelsene i straffeloven og konfliktrådsloven opp mot rettssikkerhetsprinsippene etter norsk rett. Det knyttes også bemerkninger ved rettssikkerheten til barn, ved gjeldende rett og områdene som per dags dato mangler avklaring i rettskildene.
