dc.description.abstractAvhandlingen undersøker sparebankers og sparebankstiftelsers adgang til å dele ut midler til allmennyttige formål. Den sentrale problemstillingen er å avgrense det rettslige innholdet i begrepet «allmennyttige formål», slik det benyttes i finansforetaksloven. Særlig vurderes gaveutdelinger til næringsformål og næringsvirksomhet. Adgangen til å foreta gaveutdelinger til allmennyttige formål følger av finansforetaksloven §§ 10-7 første ledd og 10-17 fjerde ledd for sparebanker, og § 12-26 tredje ledd for sparebankstiftelser.
dc.description.abstractThis thesis examines the legal authority of savings banks and savings bank foundations to allocate funds for public-benefit purposes. The central research question is to delineate the legal scope of the term "public-benefit purposes" as used in the Financial Institutions Act (finansforetaksloven). Particular attention is given to the permissibility of grants directed toward commercial purposes and business-related activities. The authority to make such allocations is provided in Sections 10-7 (1) and 10-17 (4) of the Financial Institutions Act for savings banks, and Section 12-26 (3) for savings bank foundations.
