Avhandlingen er en fremstilling og sammenligning av EF-rettens prinsipp om direktivers direkte virkning og det norske presumsjonsprinsippet. Prinsippene er med på å regulere forholdet mellom EF-retten og nasjonal rett. Sentralt i oppgaven er praksis fra EF-domstolen og Høyesterett. Eksempler på EF-domstolens praksis er Van Gend & Loos-saken, Van Duyn-saken og Marshallsaken. Den viktigste høyesterettsdommen på dette området er Rt. 2000 s. 1811, Finanger I, som har en sentral plass i oppgaven. Dommen brukes for å kartlegge presumsjonsprinsippets rekkevidde på EØS-rettens område, og i tillegg er den utgangspunktet for sammenligningen med EF-rettens prinsipp.
